3. Services and Products

  • Web Design & Development: Wiz Media offers custom web design and development services. This includes, but is not limited to, responsive website design, e-commerce platforms, and content management systems (CMS).

  • App Design & Development: We provide bespoke mobile and web app design and development services, tailored to the specific needs of each client.

  • Digital Marketing: Our digital marketing services encompass search engine optimisation (SEO), social media management, email marketing, pay-per-click (PPC) advertising, and other digital marketing strategies.

  • Custom-Made Websites and Branding Packages: Through our online shop, we sell ready-to-use websites, domain names, and branding packages (including business cards, logos, etc.). These products are designed to help clients quickly establish an online presence with minimal effort.

4. Orders and Purchases

  • By placing an order for any of our services or products, you are making an offer to purchase the service or product at the price specified on the website.

  • Once we accept your order, we will confirm your purchase via email, at which point a binding contract is formed between you and Wiz Media.

  • All prices for products and services are stated in GBP (£) and are exclusive of VAT unless otherwise stated.

5. Payment Terms

  • Full payment for products or services must be received prior to commencement of work or delivery of the product, unless otherwise agreed in writing.

  • Payments for custom services such as web and app development are typically split into instalments, with specific milestones outlined in a separate project agreement.

6. Delivery and Completion

  • For digital products such as ready-made websites or domain names, delivery will occur immediately or within a reasonable timeframe after the order is confirmed, unless otherwise specified.

  • For services such as web and app design, development, and digital marketing, estimated delivery times will be agreed upon at the start of each project. We strive to meet deadlines but are not responsible for delays outside our control.

7. Intellectual Property

  • Upon full payment for a service or product, the Client will own the intellectual property rights to the custom work created, including web designs, app designs, branding materials, and other deliverables, unless otherwise agreed.

  • Wiz Media retains the right to use general design elements, non-confidential ideas, or techniques in future projects.

  • Domain names purchased through our online shop are subject to the terms and conditions of the respective domain registrar. The Client acknowledges that they are responsible for renewing domain names to maintain ownership.

8. Confidentiality

  • Both parties agree to keep confidential any sensitive information shared during the course of the engagement, including business strategies, customer data, and proprietary software.

9. Cancellation and Refunds

  • Custom Services: For bespoke services such as web or app development, cancellation may result in a partial refund depending on the stage of work completed. All requests for cancellation must be made in writing.

  • Digital Products: Due to the nature of digital products, refunds for ready-made websites, domain names, and branding packages will not be issued unless the product is defective or not as described.

  • If the Client cancels a service or product after work has commenced, the Client agrees to pay for any work completed up until the point of cancellation.

10. Liability

  • Wiz Media will not be held liable for any indirect, special, or consequential loss, including loss of profit, data, or business opportunity, arising from the use of our services or products.

  • Our total liability for any claim shall not exceed the total amount paid by the Client for the specific service or product giving rise to the claim.

11. Limitation of Use

  • The Client agrees not to use our services, products, or websites for any unlawful, fraudulent, or harmful purposes.

  • The Client must ensure that any content provided to Wiz Media for inclusion in web or app development complies with all applicable laws and does not infringe any third-party intellectual property rights.

12. Data Protection

  • Wiz Media will handle all personal data in accordance with applicable data protection laws, including the UK Data Protection Act 2018 and the General Data Protection Regulation (GDPR).

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Wiz Media reserves the right to update or amend these Terms and Conditions at any time. Any changes will be effective once posted on our website. It is the Client's responsibility to review these Terms periodically for any updates.
